2. Applicability

These Terms and Conditions apply to all offers, quotations, and agreements between Ecomodus-haus / Easymodul.de GmbH (“we”, “us”, “our”) and the customer (“you”, “your”) concerning the purchase and delivery of modular buildings, components, or related services through our website or directly.

By placing an order, you agree to these Terms and Conditions.

3. Offers and Quotations

  1. All offers and prices displayed on our website are non-binding and subject to change.
  2. Errors or misprints in prices or product descriptions do not bind Ecomodus-haus / Easymodul.de GmbH
  3. A contract is established only when we confirm your order in writing or electronically.

4. Products and Customisation

  1. Ecomodus-haus / Easymodul.de GmbH sells modular buildings (“tiny houses”) which may be standard or customised.
  2. Images, dimensions, and specifications are indicative and may differ slightly in final delivery.
  3. Customisation requests are subject to a separate written agreement or quotation.

5. Prices and Payment

  1. All prices are stated in Euros (€), excluded of VAT unless otherwise indicated.
  2. Payments must be made via the methods offered on our website or as agreed in writing.
  3. Ordering a standard or bespoke product requires a deposit of 40 % (Fourty percent)
  4. The remaining balance must be paid before the product leaves the factory unless otherwise agreed.
  5. In case of late payment, Ecomodus-haus / Easymodul.de GmbH may charge statutory interest and collection costs. Each delayed day will endure a 0.5% of interest per day.

6. Delivery and Installation

  1. Delivery dates are indicative and not guaranteed unless explicitly agreed in writing.
  2. Delivery occurs at the address provided by the customer by email to info@tiny-huisjes.nl
  3. The customer is responsible for ensuring proper access for unloading and installation.
  4. Risk of damage or loss passes to the customer upon delivery.
  5. If the customer delays delivery or installation, storage and additional handling fees may apply.

7. Right of Withdrawal (Consumers Only)

  1. Consumers have the right to withdraw from the purchase within 14 days after receipt of the goods without providing a reason, except for:
    • Custom-built or personalised buildings;
    • Products that, by nature, cannot be returned.
  2. To exercise the right of withdrawal, you must notify us in writing via email.
  3. Upon withdrawal, you must return the product in unused condition at your own cost.
  4. If the product is returned unused and in the same condition as delivered, we will refund the amount paid within 14 days.

8. Warranty and Complaints

  1. Ecomodus-haus / Easymodul.de GmbH guarantees that all products comply with the agreement and reasonable quality standards.
  2. The standard warranty period is 2 years, unless otherwise stated.
  3. Complaints must be reported in writing within a reasonable time after discovery (maximum 14 days).
  4. If a defect is found to be covered by warranty, we will repair or replace the item free of charge.
  5. The warranty does not cover damage caused by improper use, lack of maintenance, or modifications by the customer.

9. Liability

  1. Ecomodus-haus / Easymodul.de GmbH is not liable for indirect or consequential damages, such as loss of profit or business interruption.
  2. Our total liability is limited to the invoice value of the order concerned.
  3. Nothing in these Terms excludes liability for intent, gross negligence, or statutory obligations under Dutch law.

10. Force Majeure

We are not liable for delays or failure to perform due to events beyond our control, including natural disasters, strikes, government measures, or transport issues. In such cases, we may suspend or terminate the agreement.

11. Retention of Title

Ownership of delivered goods remains with Ecomodus-haus / Easymodul.de GmbH until full payment is received.

12. Privacy

We handle all personal data in accordance with the EU General Data Protection Regulation (GDPR) and our Privacy Policy.

13. Disputes and Governing Law

  1. These Terms are governed by Dutch law.
  2. Disputes will be submitted to the competent court in the Netherlands (District Court of Noord-Holland), unless mandatory consumer protection law dictates otherwise.
